Parking ticket

This is mostly for a mate at work who was visiting a patient at college.

She was unable to park in a correct bay as none were free (so admits liability in that way). However on the ticket it states the time as 10.55, but she did not sign into the college until 11.20 (electronic sign in which I have told her to try and get evidence for) and the ticket came in a clear bag, with "Parking Charge" emblazoned on a yellow piece of paper.

So I was wondering (and this is mostly for Lady G i guess ) is she able to get off it because of the predominant yellow paper and the wrong time being taken? As I would assume this is in breach of administration for justice. I've told her to find out whether the company (UK P.A.O ltd) is acting on behalf of the local authority or acting privately.

i think it's a case of

if it's a private company and they use the yellow bag then they are impersonating an officer of the law and you can get out of it, if it's a red bag then they are playing safe.

as for the times then i think u will have them, i will pass it on to the boss and let her know you need some help

I heard on the radio tother day if it's a private company you can just say its not a legitimate ticket as you were not the driver of the vehicle, then when they ask who was driving you can respond by saying you're not legally obliged to tell them.

Many hopitals (Exeter being one) leave the car park management to the local authorities ....... but then again many local authorities (Exeter being one) use their own staff rather than the Police to manage their parking wardens ......

If the paper was yellow but the bag clear (as I beleive you suggest) then she's out of luck. Also, how far away is the car park from the college, and exactly how do you sign in "electronically" - 25mins is a pop to the shops, go get a coffee from the canteen or stop for a chat/phone call/text or two .......

I'm looking out of my office window now at two cars with nice red bags stuck to the windscreen ....... thats £100 each for two unlucky souls .....

They cannot insist that you send money before you are able to appeal. Remember - they have simply issued an invoice in respect of the damages they claim in respect of the breach of contract. This is not a fine, and so there are not the same consequences for non-payment.

She should then send them a letter setting out her case. If possible, purchase another ticket and take a date/time stamped picture of it to enclose. Suggest that their machine is faulty and ask them to prove otherwise.

If they wish to pursue her for payment of their invoice, they will have to take her to court - and will have to produce evidence to submit their claim, which I would expect they would find difficult..

Does nobody do what I do when I get a ticket... ?

Simply ask another car driver for their ticket covering that time and produce it saying ... 'Up yours'

'Your cr@P warden obviously didn't see it on my dashboard'

They will try saying 'you didn't display it properly' to which you repy ' Boll0cks, it was still on full display when I returned to my car'

Done that several times... always worked...

used to work a few years ago but now the traffic wardens have a camera built into their PDA's so they cna prove how you were parked illegally, saw a guy get done in wellington a few weeks ago. the warden took photos of all 4 corners and inside onto the dash too

You're right moose, it was yellow paper in a clear bag but she assures me she went right in.

Cheers for the advice Kim I'll let her know not to send any money, just concerned about any pay increase as with normal tickets, but I guess if it's a private company acting on behalf of the local authority they cant do that?

As Tom L said it was on the radio the other day (Month) and one of the other things that hen mentioned was that they are trying to do you for breach of contract. Which YOU have no contract with them.
The outcome of the debate was Don't send any monies off but you are best to right to them rather then just ignoring it.
